4 – NATURE OF THE INFORMATION

The content of the Website is of a general, institutional, informational, editorial, professional or commercial nature, depending on its nature and context.

Unless expressly stated otherwise, such content does not constitute legal, tax, financial, investment, expert, technical, valuation, authentication or any other form of individualized professional advice.

Consulting the Website, accessing its content or submitting a request for information does not, in itself, establish any professional, contractual, representation or advisory relationship with Monterone Art.

Any professional advice or service shall require the corresponding acceptance or formalization in accordance with the terms applicable to the specific case.

5 – INTELLECTUAL PROPERTY

The Website and its texts, design, graphic elements, logos, photographs, audiovisual material, documentation, databases, software and other content are protected by applicable intellectual and industrial property laws.

Any rights subsisting in such content belong to Monterone Art or to the respective authors, rights holders, licensors or other duly entitled third parties, as applicable.

Making such content available through the Website does not constitute an assignment or transfer of any rights in it. Any reproduction, distribution, communication to the public, adaptation or other form of exploitation shall require the relevant authorization, without prejudice to uses permitted under applicable law.

6 – WORKS OF ART AND THIRD-PARTY CONTENT

The Website may include reproductions of, or references to, works of art, photographs, drawings, manuscripts, documents, archival images, historical material, texts, publications and other content in which rights are held by third parties.

The reproduction, publication or mention of such content does not necessarily mean that Monterone Art owns the intellectual or industrial property rights in the work, document or other material concerned. Any such rights shall belong, as applicable, to the respective authors, heirs, rights holders, photographers, institutions, archives, licensors or other duly entitled third parties.

Such content shall be used in accordance with the applicable rights, licences, authorisations or other legal grounds, or where such use is otherwise permitted by applicable law. This may include, as appropriate, works in the public domain, content made available under Creative Commons licences or other licences, and content used pursuant to statutory limitations and exceptions, including those relating to quotation, research, teaching or academic use. Where possible, the author and source shall be duly acknowledged, even where such acknowledgement is not legally required.

The mention of or reference on the Website to artists, institutions, museums, galleries, auction houses, foundations, companies, publications or other third parties does not, in itself and unless expressly stated otherwise, imply any affiliation, representation, sponsorship, collaboration or commercial relationship between such third parties and Monterone Art.

Any rights holder who considers that content available on the Website infringes their rights may notify Monterone Art at contact@monteroneart.com, providing sufficient identification of the content concerned and the right alleged to have been infringed and, where appropriate, any information necessary to demonstrate that they are the rights holder or are otherwise entitled to act in relation to those rights.

The Website may contain links to websites, platforms, resources or services operated by third parties. Monterone Art does not control such third-party resources and shall not be responsible for their content, availability, security, operation or terms of use, except where liability is expressly imposed on it by applicable law.

The content of the Website should not be used as a substitute for any professional advice that may be required in connection with a particular transaction, decision or situation. To the extent permitted by applicable law, Monterone Art shall not be liable for any consequences arising from decisions made solely on the basis of general information published on the Website without the professional assessment reasonably required in the circumstances of the particular case.

8 – INTERNATIONAL ACCESS AND LANGUAGES

The Website is owned by a company incorporated under Spanish law and may be accessed from different jurisdictions and territories.

The fact that the Website can technically be accessed from a particular jurisdiction does not necessarily mean that Monterone Art directs its activities to that territory, nor that all services, activities, content, products or transactions described or referred to on the Website are offered, available or may lawfully be carried out in every jurisdiction.

Certain services, activities or transactions may be subject to territorial restrictions or to regulatory, professional, tax, administrative or customs requirements, as well as to rules relating to import and export, anti-money laundering, international sanctions, protection of cultural heritage or other matters governed by applicable law.

Where a particular activity, transaction or service is subject in a given jurisdiction to authorisation, licensing, registration, professional qualification, disclosure requirements, prior checks, territorial restrictions or any other requirement, its provision or performance shall be conditional upon compliance with the applicable legal requirements.

Information available on the Website shall not, merely because it is accessible from a particular territory, be construed as an offer, invitation, solicitation or provision of services directed at a jurisdiction in which the relevant activity may not lawfully be carried out or in which Monterone Art is not authorised to carry it out.

Monterone Art may limit, condition or exclude the availability of certain services, features, content or transactions depending on the territory, the nature of the activity, the characteristics of the client or counterparty, regulatory compliance requirements or any other legally relevant circumstance.

This Legal Notice is available in Spanish and English. Both versions are intended to reflect the same legal content, with the English version being provided to make that content accessible to international users.

In the event of any discrepancy, inconsistency, difference in scope or divergence of interpretation between the two versions, the Spanish version shall prevail to the extent that such provision is valid under any mandatorily applicable law.

9 – GOVERNING LAW AND JURISDICTION

This Legal Notice and, more generally, access to, browsing and use of the Website shall be governed by Spanish law, without prejudice to any mandatory rules applicable by reason of subject matter or jurisdiction.

Any dispute relating to the interpretation, application or enforcement of this Legal Notice or to access to, browsing or use of the Website shall be subject to the jurisdiction of the courts of Madrid, Spain.
